Terms of Service

Effective date: January 1, 2027. Last updated: March 18, 2027.

These Terms of Service (“Terms”) are a binding agreement between you (“User” or “you”) and Forge Technologies Ltd. (“Forge,” “we,” or “us”). By accessing or using any part of useforge.cloud, the Forge API, or any Forge product or service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

Forge provides a cloud-based form builder and headless form API platform (“Service”) that enables users to create, publish, and manage forms; collect and store form submission data; configure webhooks and integrations; and access form data via a REST API. The Service is provided on a subscription basis per the pricing plans listed at useforge.cloud/pricing.

2. Account Registration

To access the Service, you agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain the security of your credentials and notify us immediately of any unauthorized access at security@useforge.cloud
  • Not share your account credentials with any third party
  • Be responsible for all activity that occurs under your account

Accounts with inaccurate information or that we believe have been compromised may be suspended.

3. Acceptable Use Policy

You may not use the Service to:

  • Collect personal data without a valid legal basis under GDPR or applicable law
  • Send unsolicited communications or conduct phishing campaigns
  • Upload malicious code, malware, or content designed to compromise security
  • Attempt to reverse-engineer or derive source code from the Service
  • Submit volume abuse or denial-of-service attacks against the Forge API
  • Create forms for illegal purposes, including fraud or identity theft
  • Resell or sublicense the Service without explicit written consent from Forge
  • Collect raw payment card data (PAN) — use our Stripe Integration blocks instead

Violations may result in immediate API key revocation and account termination without notice.

4. Subscription Plans and Billing

Paid subscriptions are billed monthly or annually in advance. By providing a payment method, you authorize us to charge the applicable fees.

  • Upgrades take effect immediately. Prorated credit is applied for unused days of the prior plan.
  • Downgrades take effect at the next billing cycle.
  • Cancellations revert your account to the free tier at the end of the current billing period. Data is retained for 30 days.
  • Refunds are not generally provided, except for billing errors or SLA violations.

5. Data Ownership and Processing

You retain all rights to the form schemas you create and the submission data collected. Forge processes this data solely to provide the Service and does not sell, rent, or share submission data with third parties, except as required by law or expressly authorized by you.

You are the Data Controller for personal data collected via your Forge forms. Forge acts as a Data Processor. A GDPR Data Processing Agreement (DPA) is available for paid customers upon request to legal@useforge.cloud.

Upon account deletion, all submission data is purged within 30 days. You may export data at any time via the API or dashboard before deletion.

6. Intellectual Property

The Forge name, logo, and proprietary functionality are owned by Forge Technologies Ltd. and protected by copyright and trademark law. These Terms do not grant rights in the Service beyond the limited license to use it as described herein.

Open-source SDKs (including @forge/react) are licensed under the MIT License. See individual repository licenses for details.

7. Service Level Agreement (SLA)

We target 99.9% API uptime for Standard plans and 99.99% for the Secure plan. Scheduled maintenance windows, if required, will be announced at least 24 hours in advance via our status page.

Service credits for SLA violations are the sole remedy for downtime and are limited to credit toward future subscription fees. We do not provide monetary refunds for SLA violations.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FORGE IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. FORGE'S TOTAL CUMULATIVE LIABILITY IS LIMITED TO THE GREATER OF (A) FEES PAID TO FORGE IN THE TWELVE MONTHS PRECEDING THE EVENT OR (B) ONE HUNDRED US DOLLARS ($100).

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Modifications to Terms

We will provide at least 30 days' notice via email prior to material changes taking effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Disputes shall first be subject to good-faith negotiation, and if unresolved within 30 days, submitted to binding arbitration under LCIA rules. Emergency injunctive relief may be sought in any court of competent jurisdiction.
